Despite being an original certiorari proceeding, G.R. No. 138993 tolled the running of the prescriptive period. An analysis of its peculiar nature justifies taking it out of the ambit of the rule that certiorari proceedings do not toll the running of the prescriptive period. (PVB v. Solid Homes, G.R.
