Weight Given to Factual Findings of Trial Court

The rule on the weight to be given to the findings of the trial court does not unqualifiedly apply, when the judge who rendered the decision did not hear the principal evidence of the prosecution. For in such, case, his evaluation of the evidence is based on the transcript of stenographic notes, which also forms the basis for the Court of Appeals to review the trial court’s decision and render its own decision.
